Terms of Use

Welcome to MaishaPesa! These Terms of Use (“Terms”) govern your use of the MaishaPesa platform and services. By registering or using any part of our services (“Service”), you confirm that you have read, understood, and agreed to these Terms. If you do not agree, please do not access or use the Service. 

 

These Terms form a binding legal agreement between you (“You” or “Your”) and MaishaPesa (“We,” “Us,” or “Our”). We may update these Terms from time to time, and any changes will be effective upon publication. We will notify you of significant changes through email or in-app notifications. 

 

 1. Definitions 

In these Terms, the following terms shall have the meanings set out below: 

- Account: Your personal account to access the Service. 

- Applicable Laws: All laws, regulations, and rules in effect in Tanzania, including the Anti-Money Laundering Act and the Personal Data Protection Act. 

- Business Day: Any day except Saturdays, Sundays, or public holidays in Tanzania. 

- Credit Reference Bureau: The Credit Reference Bureau of Tanzania, which collects and distributes credit information. 

- Loan: The principal amount of a loan granted to you under these Terms. 

- Mobile Device: Your smartphone, tablet, or other device used to access the Service. 

- Personal Information: Data that identifies you, such as your name, address, phone number, and financial information. 

- Service Fees: Fees charged for using the Service, as published on the App. 

- SIM Card: The subscriber identity module used to access mobile networks. 

- System: The MaishaPesa platform, including the App, website, and related systems. 

 

 2. Your Responsibilities 

By using the Service, you confirm and agree that: 

1. You have the legal capacity to enter into these Terms. 

2. You will comply with all Applicable Laws and these Terms. 

3. You will use the Service only for lawful purposes. 

4. All information you provide is accurate, complete, and not misleading. 

5. You will not engage in fraudulent, illegal, or harmful activities, including money laundering or terrorist financing. 

6. You will not disrupt the Service or its network. 

 

 3. Acceptance of These Terms 

1. By downloading the App or registering an Account, you agree to these Terms. 

2. We may update these Terms from time to time. Your continued use of the Service constitutes acceptance of the updated Terms. 

3. You consent to us collecting technical data about your device to improve the Service. 

4. You authorize us to share your credit information with the Credit Reference Bureau. 

 

 4. Use of the Service 

1. The Service is available only to individuals aged 18 or older. 

2. We may reject or cancel your Loan application at any time without providing a reason. 

3. Loan terms, including interest rates, will be displayed on the App. 

 

 5. Use of the System 

1. You are granted a limited, non-exclusive license to use the System for personal purposes. 

2. You may not: 

   - Copy, modify, or reverse-engineer the System. 

   - Use the System for commercial purposes. 

   - Engage in fraudulent or illegal activities. 

3. Violations may result in account suspension or termination. 

 

 6. Your Account 

1. You must register and maintain an Account to use the Service. 

2. You are responsible for all activities on your Account. 

3. Notify us immediately if you suspect unauthorized access to your Account. 

4. We may suspend or terminate your Account for breaches of these Terms. 

 

 7. Personal Information 

1. We will process your Personal Information in compliance with the Personal Data Protection Act of Tanzania and as described in our Privacy Policy. 

2. You may update or delete your information by contacting us. 

3. We will not share your Personal Information with third parties without your consent, except as required by law or to prevent fraud. 

 

 8. Financial Terms 

1. Interest and Fees: Interest rates and Service Fees will be displayed on the App. We may update fees and will notify you of changes. 

2. Taxes: You are responsible for any taxes on payments made under these Terms. 

3. Payment: Payments must be made in Tanzanian Shillings on or before the due date. 

 

 9. Default and Termination 

1. An event of default occurs if you fail to make payments for 15 days. 

2. Upon default, we may: 

   - Terminate these Terms. 

   - Demand immediate repayment of all outstanding amounts. 

   - Report the default to the Credit Reference Bureau. 

3. These Terms remain in effect until terminated. We may terminate your access for breaches of these Terms or for security reasons. 

 

 10. Liability and Indemnification 

1. Indemnification: You agree to indemnify us for any losses caused by your breach of these Terms or misuse of the Service. 

2. Exclusion of Liability: 

   - We are not liable for service interruptions caused by your device or third-party systems. 

   - Our maximum liability is limited to the total fees paid by you in the last 12 months. 

 

 11. Third-Party Sites 

1. We may provide links to third-party websites for informational purposes only. 

2. We are not responsible for the content, accuracy, or security of third-party sites. 

 

 12. Marketing Communications 

1. By using the Service, you consent to receive marketing communications from us. 

2. You may opt out of marketing communications at any time. 

 

 13. Dispute Resolution 

1. These Terms are governed by Tanzanian law. 

2. Disputes will be resolved through arbitration in Dodoma, Tanzania, in accordance with the Arbitration Rules. 

3. The arbitrator’s decision is final and binding. 

 

 14. Anti-Money Laundering (AML) Compliance 

1. Prohibition of Illegal Activities: You agree not to use the Service for any illegal activities, including money laundering or terrorist financing. 

2. Reporting Obligations: We are required by law to report suspicious transactions to the Financial Intelligence Unit (FIU) of Tanzania. 

3. Customer Due Diligence (CDD): You agree to provide accurate and complete information for identity verification purposes. 

 

 15. General 

1. We may update these Terms at any time. Continued use of the Service constitutes acceptance of the updated Terms. 

2. You may not assign your rights or obligations under these Terms without our consent. 

3. If any part of these Terms is found to be invalid, the remaining terms will remain in effect.
